To provide a comprehensive view of the issues relating to the application of ratified Conventions on occupational safety and health (OSH), the Committee considers it appropriate to examine Conventions Nos 119 (guarding of machinery) and 120 (hygiene (commerce and offices)) together.
Legislative developments. The Committee takes due note of the adoption of the Occupational Safety and Health and Prevention of Occupational Hazards Regulation No. 31 of 2023, as well as new regulations and instructions regarding medical care in establishments, OSH committees and risk assessments, among others.
Application of Conventions Nos 119 and 120 in practice. The Committee notes the information in the Government’s report that the number of occupational accidents and diseases reported to the Social Security Corporation decreased between 2023 and 2022, by approximately 14 per cent (19,683 reported in 2023 compared with 22,861 in 2022). The Government indicates that, in 2023, the highest percentages of work injuries occurred in the manufacturing sector (30.2 per cent of injuries), in public administration, defence and social security (17 per cent) and in wholesale and retail trade activities (15.7 per cent). The Committee also notes the detailed information provided regarding the number of inspection visits and their results, as well as the issues detected, including the number of undertakings where violations were noted related to machine maintenance. The Committee requests the Government to continue to provide informationon the application in practice of the ratified Conventions on OSH, including the number, nature and cause of the occupational accidents and diseases notified, including relevant information concerning safety and health in offices and commerce, as well as machine safety.

Protection against specific risks

Guarding of Machinery Convention, 1963 (No. 119)

Articles 2 and 4 of Convention No. 119. Obligations related to the sale, hire, transfer and exhibition of machinery. The Committee takes due note of the Government’s reference to the provisions in Regulation No. 31 of 2023 on the obligations of employers related to machine safety, including relating to the posting of notices regarding applicable risks and the carrying out of periodic maintenance (section 8). It notes with interest that the Instructions identifying the types of sources of occupational hazards in the work environment and the necessary precautions and measures for protection of 2023 (issued pursuant to section 79 of the Labour Law and Regulation No. 31) outline the obligations of employers regarding machinery, including a prohibition on selling, renting or transferring machinery and equipment if the dangerous parts are not provided with adequate protective guards. Recalling that the obligation in Article 4 also applies to the manufacturers of machinery, the Committee requests the Government to provide information on any measures taken to ensure that manufacturers of machinery are prohibited from selling or transferring machinery without appropriate guards.
