In order to provide a comprehensive view of the issues relating to the application of the ratified Conventions on wages, the Committee considers it appropriate to examine Conventions Nos 26 and 99 (minimum wages) together.
Legislative developments. The Committee notes the adoption on 19 November 2021 of Act No. 022/2021 issuing the Labour Code and repealing Act No. 3/94 of 21 November 1994 issuing the Labour Code, as well as subsequent amending texts and all previous conflicting provisions.
Article 3, paragraph 2(1) and (2), of Convention No. 26 and Article 3(2) and (3) of Convention No. 99. Participation of the social partners. Further to its previous comment on the representativity of trade unions, the Committee notes the Government’s indication in its reports that section 317 of the new Labour Code sets out criteria to assess the representativity of trade unions. The Committee also notes the Government’s indication that, as a result of the technical assistance provided by the ILO, the first occupational elections for the recognition of the most representative unions, and as a consequence the establishment of the National Commission for Wage Studies (CNES), will be organized. The Committee requests the Government to provide information on the progress achieved in the establishment of the CNES and on any meetings held on the subject of the fixing of the minimum guaranteed interoccupational wage (SMIG).
