Article 2 of the Convention. Application to public officials. Further to its previous comments, the Committee notes the absence of information in the Government’s report regarding the application of the Convention to public officials. In this respect, the Committee observes that Law No. 24/1960 for the Civil Service and Law No. 22 of 2008 concerning the salaries of Government employees and public sector employees do not contain provisions giving effect to the Convention. Therefore, the Committee requests the Government to take the necessary measures to ensure that the Convention is applied to public officials, who are excluded from the application of Labour Law No. 37 of 2015, and to provide information in this regard.
Article 3(1). Payment of wages in legal tender. In its previous comments, the Committee took note of section 53(1) of Labour Law No. 37, which provides that wages due to workers shall be paid in Iraqi currency, unless otherwise specified in the employment contract. Noting the absence of information in this regard and recalling that wages payable in money shall be paid only in legal tender, in accordance with Article 3(1) of the Convention, the Committee requests the Government to take the necessary measures to give effect to this Article of the Convention. It also requests the Government to provide information on any cases where payment of wages otherwise than in Iraqi currency is provided for in the employment contract in application of the exception authorized under section 53(1) of Labour Law No. 37.
Article 7(2). Works stores in remote areas. In its previous comments, the Committee requested the Government to provide information on the decisions adopted to give effect to sections 41(2)(o) and 111 of Labour Law No. 37, concerning the provision of goods and services in remote locations and in quarries, mines and mineral extraction sites. The Committee notes the absence of relevant information in this regard. The Committee requests the Government to take the necessary measures to ensure that where access to other stores or services is not possible, appropriate measures shall be taken with the objective of ensuring that stores established and services operated by the employer are not operated for the purpose of securing a profit but for the benefit of the workers concerned, in accordance with Article 7(2) of the Convention. It further requests the Government to provide information on how sections 41(2)(o) and 111 of Labour Law No. 37 are applied in practice.
