Article 3(2) of the Convention. Additional duties entrusted to labour inspectors.The Committee once again requests the Government to take the necessary measures to ensure, in accordance with Article 3(2) of the Convention, that the additional duties assigned to labour inspectors regarding the inspection of work permits of foreigners do not interfere with the main objective of labour inspection to secure the enforcement of legal provisions relating to conditions of work and the protection of workers, as required under Article 3(1) of the Convention. The Committee also reiterates its request that the Government indicate if any other additional functions are entrusted to labour inspectors under section 8.2(d) of the 2015 Decent Work Act, and to indicate the time and resources allocated by labour inspectors to each of their additional duties, as compared to their primary functions.
Articles 10 and 11(1). Adequate human resources and material means. The Committee takes note of the Government’s indication in its report that labour inspectors are provided with offices in the political seat of each first-level government subdivision and that, in the event where the political seat is not the economic hub, another inspector is assigned to the economic hub. The Committee notes the Government’s indication that the resources for inspectors’ mobility need improvement but that the resources allocated to labour inspection services are subject to the Government’s fiscal space. The Committee urges the Government to intensify its efforts to ensure that: (i) the number of labour inspectors is sufficient to secure the effective discharge of the inspection functions, taking into account the criteria set out in Article 10(a)–(c) of the Convention; and (ii) labour inspectors have the necessary material means to carry out their functions effectively, including local offices, suitably equipped and accessible to all persons concerned, and adequate transport facilities, in accordance with Article 11(1). The Committee requests the Government to provide information on any progress made in this respect.
The Committee is raising other points in a request addressed directly to the Government.
