Article 2(1) of the Convention. Prohibition on employing children under 18 years of age at night in industrial undertakings. The Committee recalls that the provisions of the Factories Act of 1951 prohibit night work in factories between the hours of 6 p.m. and 6 a.m. for children up until the age of 16 (section 79(1) and (2)). Under section 79(3), and contrary to the requirements of the Convention, young persons between the ages of 16 and 18 may be declared by a registered medical doctor to be fit for employment and allowed to work between the hours of 6 p.m. and 6 a.m.
The Committee notes the military authorities’ information, in their report, that the Factories and General Labour Laws Inspection Department (FGLLID) has issued an instruction to prohibit the employment of young persons under the age of 18 in any night shifts. The Committee encourages the military authorities to formalize the FGLLID instruction prohibiting the employment of young persons under 18 in night work through binding legislative or regulatory measures, and requests that they ensure its effective enforcement through strengthened inspections and monitoring mechanisms. The Committee requests the military authorities to provide information on the steps taken in this regard, including statistics on inspections, any violations detected, and on any progress made toward integrating this prohibition into the national legal framework.
