Article 5 of the Convention. Payment of worker’s compensation to survivors. The Committee takes note of the information provided by the Government in its report that survivors are entitled to pension due to the death of the breadwinner, provided that the entitlement conditions are met. The Committee further notes that, according to section 85(1) of Decree Law No. 19-2022 of 15 July, survivors are entitled to respective benefits provided that workers who suffered an employment injury were entitled to invalidity or old-age pensions at the time of their death.
Article 7.Additional compensation when the victim needs the constant assistance of another person. The Committee notes the Government's indication that additional compensation would be provided by Decree-Law No. 25-2014. The Committee notes that this decree appears to have been replaced by Decree-Law No. 19-2022, and that neither of these decrees provides for additional compensation when the victim of an accident at work needs the constant assistance of another person. In this context, the Committee once again requests the Government to provide information regarding the legal provisions guaranteeing the additional compensation, including its level and the conditions for its payment.
Articles 9 and 10. Provision of surgical care and renewal of prosthetic limbs and orthopaedic devices. The Committee takes note of the information that victims of employment injuries receive medical care and related benefits conferred on them by law once they have been registered with the Social Security Services. The Committee notes, however, that the Government does not indicate the legal provisions or national policy framework that guarantees the provision of surgical care or prosthetic limbs and orthopaedic devices. The Committee further notes that, according to the National Development Health Plan (2017–2021), the improvement of access to health services for people with disabilities was among the objectives of the Government. The Committee requests the Government to provide information regarding the legal provisions guaranteeing surgical care and renewal of prosthetic limbs and orthopaedic devices to victims of employment injuries, and to indicate the measures adopted or envisaged in the context of the National Development Health Plan in this regard.
