Article 1(1) and (2) of the Convention. Scope of application. In reply to its previous comment, the Committee notes the adoption of the Maritime Navigation Law in 2020 as well as the adoption of the Rules on Rulebook on the seafarer’s identity document in February 2024. It observes that, in accordance with section 6, paragraph 27, of the Maritime Navigation Law, seafarer refers to any person who is employed or performs the service or who works in any capacity on a ship or yacht intended for commercial activity. The Committee takes note of this information.
Article 1(3). Application to commercial maritime fishing. In reply to its previous comment, the Committee notes the Government’s indication that the issue regarding the application of the Convention to commercial maritime fishing will be addressed in the draft of the revision of Law on Maritime Safety Navigation. The Committee requests the Government to provide information on any developments in this regard.
Article 2. Issuance of SIDs. The Committee notes the Government’s information that the seafarer’s book is regulated under the Law on Maritime Safety Navigation and other regulations. It notes that according to section 124 of the Law on Maritime Safety Navigation in force, the seafarer’s book shall be issued to a Montenegrin national signed on as a master or a crewmember of a vessel of Montenegrin or foreign nationality. Subject to the comments under Article 3 below, the Committee requests the Government to specify whether seafarers' identity documents may also be issued to seafarers who have been granted the status of permanent resident in its territory, as allowed under Article 2(3).
Articles 3–5. Requirements of SIDs. The Committee notes that the Government does not provide information on the content and form of the seafarers’ book. It further notes the Government’s statement that it will amend the Law of Maritime Safety Navigation to ensure compliance with the Convention. The Committee accordingly requests the Government to adopt the necessary measures to ensure conformity with Articles 3-5 and with the detailed requirements of Annexes I–III, as amended in 2016. It also requests the Government to transmit a copy of the amended legislation and to supply a specimen of the SID issued in conformity with the Convention.
Article 6. Facilitation of shore leave and transit and transfer of seafarers. In reply to its previous comment, the Committee notes the Government’s indication that this issue will be addressed in the revision of the Law on Maritime Safety Navigation, which is still under discussion. The Committee requests the Government to adopt the necessary measures to ensure compliance with this provision of the Convention.
