Article 3. Exceptions to the prohibition on employment in night work for persons between the ages of 16 and 18 years. The Committee notes the Government’s indication in its report that Act No. 2024-048/PR of 31 December 2024 repeals and replaces certain provisions of the Labour Code. The Committee further notes that the Act introduces a new section 155 into the Labour Code, which provides for the prohibition of night work (from 8 p.m. to 8 a.m.) for children under the age of 16 years. The Committee also observes that the new section 166 provides that the list of types of work and the conditions governing night work for children under the age of 18 years will be established by regulation, following consultation with the National Council for Labour, Employment and Social Security. The Committee requests the Government to indicate whether the list of types of work and the conditions governing night work for children between the ages of 16 and 18 years, as envisaged under the new section 166 of the Labour Code, have been established, and to provide a copy thereof.
