Article 4(1) of the Convention. Partial payment of wages in kind. Further to its previous comments, the Committee notes the Government’s indication in its report that section 2099, paragraph 3, of the Civil Code, which allows the full payment of wages in kind, has been effectively superseded by subsequent legislation, making an amendment or abrogation a formality. In this regard, it indicates that article 1(910) of Law No. 205 of 27 December 2017 on State budget for the 2018 financial year and multi-year budget for 2018–20 stipulates that as of 1 July 2018, employers and commissioning parties can no longer pay workers in cash, irrespective of the employment relationship, and payments must therefore be made through a bank or post office. The Committee also notes the Government’s indication that the setting of wages is delegated to collective contracting and there are currently no collective agreements whereby wages may be paid entirely in kind. While taking note of the Government’s explanations, the Committee observes that section 2099, paragraph 3, of the Civil Code is still in force. Therefore, the Committee requests the Government to indicate the measures taken or envisaged in order to bring the above-mentioned provision of the Civil Code in conformity with the Convention.
