Article 5 of the Convention. Proper utilization of the compensation paid in the form of a lump sum. The Committee requests the Government to provide information on whether its national legislation envisages the possibility to convert, wholly or partially, a periodical payment into a lump sum and, if so, how it is ensured that the competent authority is satisfied of its proper utilization.
Article 7. Additional compensation to injured workers requiring the constant help of another person. The Committee notes that section 57(1) of the National Insurance (Benefit and Assistance) Regulations provides for additional compensation, equal to 20 per cent of the disability benefit, to be paid to persons with disability assessed at 100 per cent and requiring constant care and attendance. The Committee requests the Government to indicate whether: (i) this additional compensation will also be paid to beneficiaries requiring the constant help of another person irrespective of the degree of disability; and (ii) such additional compensation is also provided in the case of temporary incapacity.
The Committee has been informed that, based on the recommendations of the Standards Review Mechanism Tripartite Working Group (SRM Tripartite Working Group), the Governing Body has decided that Member States for which Convention No. 17 is in force should be encouraged to ratify the more recent Employment Injury Benefits Convention, 1964 [Schedule I amended in 1980] (No. 121), or the Social Security (Minimum Standards) Convention, 1952 (No. 102), accepting its Part VI (see GB.346/LILS/1). Conventions Nos 121 and 102 reflect the more modern approach to employment injury benefits. The Committee therefore encourages the Government to follow up on the Governing Body’s decision at its 346th Session (October–November 2022) approving the recommendations of the SRM Tripartite Working Group and to consider ratifying Convention No. 121 or Convention No. 102 (Part VI) as the most up-to-date instruments in this subject area. The Committee reminds the Government of the possibility to avail itself of the technical assistance of the Office in this regard.
