In order to provide a comprehensive view of the issues relating to the application of the ratified Conventions on wages, the Committee considers it appropriate to examine Conventions Nos 26 (minimum wages) and 95 (protection of wages) together.

Minimum wages

Article 4 of Convention No. 26. Effective application in practice. Informal sector. Further to its previous comments concerning the payment of the minimum wage to workers in the informal sector, the Committee notes the Government’s indication in its report that it has put in place a certain number of measures to facilitate the creation of enterprises to encourage the transition of many of them to formality. The Committee observes, however, that the Government does not indicate the manner in which it guarantees the payment of the minimum wage to workers who are still in the informal sector. The Committee requests the Government to provide information on the measures taken or envisaged to ensure that all workers in the informal sector receive the minimum wage.

Protection of wages

Articles 8 and 10 of Convention No. 95. Deductions from and attachment and assignment of wages. Further to its previous comments, the Committee notes the Government’s indication in its report that the legislation on wage deductions has not changed during the period in question and that its comments will be taken into account in the draft Labour Code under revision. The Committee requests the Government to provide information on the measures taken or envisaged to align its legislation and practice with these Articles of the Convention, including through the revision of the Labour Code. It also requests the Government to provide information on the adoption of any new legislation in this regard.
