The Committee notes the Government’s reply to the 2019 observations of the General Confederation of Labour (CGT), included in its report. The Committee also notes the observations of the CGT, the Confederation of Workers of Colombia (CTC) and the Single Confederation of Workers of Colombia (CUT) of 1 September 2023, sent by the Government. The Committee also notes the observations of the National Employers Association of Colombia (ANDI), received on 1 September 2023. The Committee further notes the observations of the International Organisation of Employers (IOE), received on 27 August 2024, and also the Government’s reply, received on 3 October 2024. The Committee requests the Government to provide its comments on the observations of the ANDI.
Articles 2 and 5. Effective tripartite consultations. The Committee notes the detailed information provided by the Government on the tripartite consultations held in the Standing Committee for Dialogue on Wage and Labour Policies (CPCPSL) between June 2019 and June 2023. The Government indicates that: (i) tripartite consultations were held on the possible ratification of the Violence and Harassment Convention, 2019 (No. 190); (ii) on 13 and 14 February 2023, a report was disseminated at the ILO regarding gaps in the national legislation relating to the Social Security (Minimum Standards) Convention, 1952 (No. 102); and (iii) on 15 March 2016, the Workers with Family Responsibilities Convention, 1981 (No. 156), was publicized in the Subcommittee on International Affairs; and (iv) on 4 October 2022, information meetings with members of the CPCPSL were convened with regard to the bill concerning the ratification of Convention No. 156 in the Second Standing Constitutional Committee of the Senate. In this context, the Committee notes with interest the ratification of Convention No. 156 on 6 December 2024. The Government also indicates that the possible denunciation of certain Conventions has been examined with a view to making progress on the ratification of Conventions replacing them, with advice received from the ILO on the Maritime Labour Convention, 2006, as amended (MLC, 2006). The Committee also notes the information provided by the Government on the tripartite consultations held on reports on ratified Conventions to be sent to the Office under article 22 of the ILO Constitution. Lastly, the Committee notes the detailed information included in the Government’s report on the sessions of the CPCPSL roundtable following up the application of the Domestic Workers Convention, 2011 (No. 189).
The Committee notes that the ANDI asserts in its observations that no effective tripartite consultations were held in the CPCPSL prior to the ratification of Convention No. 156 but that this discussion took place in the National Congress. The Committee also notes that the IOE states in its observations that the tripartite social dialogue forums have not been convened for months and the last time the CPCPSL was convened was in February 2024. In this regard, the ANDI urges the Government to revive the tripartite dialogue forums in a climate of confidence based on respect for the employers' organizations and the trade unions. The Committee further notes that the CUT, CTC and CGT in their observations underline the Government’s efforts to promote tripartism in the country. The Committee notes that the Government in its reply adds a timetable of the 2024 sessions of the CPCPSL, including the Subcommittee on International Affairs, up to September 2024. The Committee requests the Government to continue providing up-to-date, detailed information on the content and outcome of the tripartite consultations held on all matters related to international labour standards covered by Article 5(1) of the Convention.
