The Committee notes the observations made by the General Federation of Nepalese Trase Unions (GEFONT) received on 1 September 2024 and asks the Government to provides its response thereto.
Article 5 of the Convention. Effective tripartite consultations. The Committee notes that the Central Labour Advisory Council (CLAC) met twice in 2022, then once in 2023 and 2024, with its most recent meeting held in January 2025. It observes that, during this meeting, the Council recommended that the Government ratify several conventions, including the Labour Inspection Convention, 1947 (No. 81), the Freedom of Association and Protection of the Right to Organize Convention, 1948 (No. 87), and the Forced Labour Convention, 1930 (No. 29), and its 2014 Protocol.
The Committee further notes that the Government plans to convene the CLAC at least three times per year, establishing a mechanism for periodic review and dissemination of outcomes from tripartite consultations. In this context, the Committee notes the observations made by the General Federation of Nepalese Trase Unions (GEFONT), which emphasizes that, although key tripartite bodies have been established, the process would benefit from greater information-sharing, transparency, and inclusion. GEFONT calls for a more transparent, inclusive, and accountable approach that genuinely reflects the interests and concerns of all stakeholders – particularly workers – in the implementation of international labour standards in the country.
The Committee requests the Government to provide updated information on the activities of the Central Labour Advisory Council, including the content and outcomes of tripartite consultations held during each reporting period on matters related to international labour standards under the Convention. The Committee also requests the Government to report how it ensures transparency and inclusion in the consultative process, including through the timely dissemination of agenda and working documents prior to meetings. Furthermore, the Committee requests information on the content and outcome of consultations held not only on the ratification of Conventions (Article 5(1)(c)), but also on: (a) government replies to questionnaires concerning items on the International Labour Conference agenda; (b) proposals to be made to the Federal Parliament in connection with the submission of new instruments (Article 19); and (c) reports to be made to the ILO on the application of ratified Conventions (Article 22).
Article 4(2). Training on consultative procedures. The Committee notes that the Government intends to organize training programmes for all members of the CLAC to ensure effective meetings and the implementation of the Council’s decisions. It further notes the adoption of the Decent Work Country Programme for Nepal (2023–27), whose Outcome 3 aims to strengthen representative and influential tripartite constituents and promote effective social dialogue. The Committee requests the Government to provide specific information on the training offered to members of the Central Labour Advisory Council (CLAC), including the number of participants from workers’ and employers’ organizations and the topics covered. Please indicate how this training utilizes the resources available under outcome 3 of the DWCP (2023–27) to ensure that participants possess the necessary knowledge to engage effectively in the consultative procedures.
