Article 2(4) of the Convention. Prompt issuance of seafarers’ identity documents. The Committee had noted the Trade Unions Federation of Workers of Maritime Transport (FPRMT)’s concern on the adoption of Order No. 134 of 27 May 2014 of the Ministry of Transport, which amends Ministerial Order No. 213 of 19 December 2008 on the instructions on the procedure for the identification of seafarers. The FPRMT indicated that under Order No. 134, seafarers applying for a Seafarers’ identity documents (SIDs) shall have any documents issued abroad legalized and present a notarized translation of documents drawn up in a foreign language. According to the FPRMT, these amendments, by complicating the procedures to obtain SIDs and entailing additional expenses for the applicants, do not ensure full compliance with the Convention. The Committee notes that, in reply to its previous comments regarding the need to ensure that SIDs are issued without delay, the Government indicates that procedures for issuing SIDs are regulated by Order No. 213 of 19 December 2008, which establishes a maximum processing time of 15 calendar days. The Committee further notes the Government’s explanation concerning the requirement of notarized translations of foreign documents, intended to avoid discrepancies in data. The Committee requests the Government to indicate the average time currently required for the issuance of SIDs in practice and to provide information on measures taken to ensure that the translation requirement does not hinder the effective and timely issuance of SIDs as required by the Convention.
Articles 3–5. Seafarers’ identity documents. In reply to it previous comment, the Committee notes the Government’s indication that efforts are under way to implement the amended requirements of the Convention, including SID issuance and control (Rosmorrechflot’s segment of the national migration and registration system). The Committee requests the Government to adopt the necessary measures without further delay to ensure conformity with the Convention, and to provide information on the adoption of legislation or other means through which the requirements of Articles 3–5 and Annexes I–III of the Convention, as amended in 2016, are implemented.
