In this regard, please be informed that our Administration takes seriously this case and we are pressing the owner and operator to solve this matter as soon as possible.

Dear Mr. *** and Mr. ***,
Thank you for your continued communication and your efforts on this matter. We also extend our sincere thanks to the ITF and the flag state (Tanzanian authorities) for their engagement.
Please find below a clear update regarding the current situation of the Anna I.
1. Supplies
· Fuel: Has been delivered to the vessel.
· Water: Is available on board.
· Food: Will be supplied within a few days.
2. Wages
The salary payments have been transferred by the company FAIRTRADE COMPANY. The bank requested supporting documents which have been provided accordingly. The crew members are now kindly requested to wait for the funds to appear in their respective bank accounts.
3. Vessel current location and detention
We respectfully advise that the vessel has been in Venezuela for 1.5 years and is currently anchored in Puerto La Cruz. For your reference, there are 2 LCIA arbitration orders that the local authorities ignore, the LCIA Tribunal operates under international law, and its decisions are legally binding and prevail conflicting local measures:
· First Award (23 April 2025): The LCIA Tribunal permitted the Owner to sell the cargo;
· Procedural Order No. 2 (8 August 2025): The LCIA Tribunal ordered to ensure the vessel's prompt and safe departure. There was restrained from taking any steps to prevent the vessel from sailing.
However, the local Venezuelan authorities do not respect the LCIA orders.

Despite these international orders, the local Venezuelan authorities continue to detain the vessel.

This prolonged detention of 1.5 years has caused significant harm to both the shipowners and cargo owners. The situation has, at times, led to irregularities in salary payments. Nevertheless, we wish to emphasise that we, as the shipowners, continue to provide the crew with the needs to the best of our ability.
We hope for your understanding of this matter, which is due to non-compliance with the international arbitration orders by the Venezuelan local authorities.
We will continue to keep you updated on any further developments. Thank you again for your patience and cooperation.

At this point we are seeking firm payment confirmation as well as repatriation details.

As soon as we have more information, we will revert accordingly.

I herewith would like to kindly call on all responsible States, including the flag State Zanzibar (United Republic of Tanzania) and port State Venezuela, to take urgent and immediate action, as appropriate and in conformity with the attached joint IMO/ILO Guidelines on how to deal with seafarer abandonment cases.

All information received will be recorded on the joint ILO/IMO database on abandonment of seafarers.

Nosotros, los (06) miembros de la tripulación del buque ATB ANNA I/ MARIA, nos dirigimos a ustedes como último recurso. Reportamos formalmente a la empresa Eternus Group por negligencia sistemática y abandono. A pesar de nuestra comunicación constante con la Srta. *** o *** (teléfono: +***) la compañía ha ignorado nuestras peticiones, dejándonos en estado crítico y vulnerable

Ponemos en su conocimiento las siguientes violaciones:
-Graves atrasos salariales: Se adeudan a la tripulación más de tres meses de salarios. cabe destacar que el capitán del buque se le adeudan seis meses y 15 días, lo cual representa un incumplimiento flagrante del CONVENIO SOBRE EL TRABAJO MARÍTIMO (MLC 2006)

-Emergencia Humanitaria: el buque desde el día 23 de Abril hasta el día 16 de Mayo sin combustible y no recibimos desde hace 13 días las provisiones . Al no tener combustible, carecemos de electricidad para la conservación de los pocos alimentos restantes para cocinar, ni para cubrir necesidades sanitarias básicas. La privación de alimentos y energía constituye un riesgo directo a nuestras vidas, salud física y mental.
solo se recibió el día 16 de mayo el abastecimiento de 03 toneladas de diesel lo cual solo representa una semana de uso de generador a bordo.

-Contrato Vencidos y Permanencias forzadas: los 06 miembros de la tripulación tienen contratos vencidos. Esto incluye a dos miembros que han estado a bordo por más de un año y otros dos que presentaron renuncias formales en febrero del presente año, pero a quienes Eternus Group. Nos ha denegado nuestros derecho al desembarque.

-Incomunicación Forzada y Negligencia de la Empresa: La comunicación con la srta *** no ha dado ningún tipo de respuestas ni resultados, demostrando un desprecio total por las regulaciones internacionales respecto al bienestar de los marinos. Además, denunciamos que actualmente no contamos con servicio de internet y que la empresa ha cortado deliberadamente nuestro servicio de correo corporativo, con el fin de dejarnos incomunicados y evitar que reportemos esa situación a las autoridades externas.

Como autoridades competentes, les instamos a intervenir de inmediato para obligar a Eternus Group a suministrar provisiones y combustible, liquidar todos los salarios pendientes y gestionar nuestra repatriación urgente
