    Extract:

    The EPO seeks an order for costs against the complainant on the basis that his complaint was frivolous (see Judgments 4722, consideration 6, 4717, consideration 4, and the case law cited therein). It was, and for the reasons the EPO gave. In proceedings where costs are ordered to be paid by one party, usually the defendant organisation, to another party, usually a successful complainant, the amount of costs will usually depend on the nature of the legal representation of the successful party. If the successful party was represented by external lawyers, they are usually paid 10,000 euros or an equivalent amount. In point of principle, once liability to pay costs is established, the amount should be the same. In this case, the EPO was represented by external lawyers. However, the EPO explicitly limits its claim for costs to 1,000 euros. Accordingly, costs of that amount should be ordered. The complainant, a frivolous litigant in these proceedings, should be ordered to pay the EPO 1,000 euros.

    La demande de l’organisation tendant à ce qu’il soit ordonné à l’intéressé de payer, en raison du caractère prétendument futile et abusif de sa requête, les frais de procédure et l’ensemble des frais du dossier est, par suite, rejetée. Comme il a été dit dans les jugements 4947 et 4948, également prononcés ce jour, au sujet de demandes semblables que la CPI a formulées mécaniquement à l’encontre de chacune des cinq requêtes du requérant découlant des mesures prises à la suite de l’incident du 11 octobre 2021, cette demande est manifestement injustifiée et dénuée de tout fondement, et plus encore en l’espèce au regard du fait que la requête concerne la contestation d’un renvoi sans préavis pour faute grave.

    Dans ses écritures, la CPI demande qu’il soit ordonné au requérant de payer les dépens, les frais de procédure et l’ensemble des frais du dossier, au motif que la requête serait non seulement infondée, mais également futile et abusive. Le Tribunal observe que l’organisation formule d’ailleurs une telle demande, mécaniquement et sans nuance, à l’encontre de chacune des cinq requêtes du requérant découlant des mesures prises à la suite de l’incident du 11 octobre 2021, dans ce qui semble s’inscrire dans une tactique regrettable, voire elle-même abusive dans la mesure où elle viserait à dissuader le requérant d'exercer ses droits.
    Comme il a déjà été dit dans le jugement 4947, également prononcé ce jour, la condamnation d’un requérant aux dépens ne peut être prononcée que dans des circonstances exceptionnelles.
    En l’espèce, cette demande est à l’évidence injustifiée.

    Dans ses écritures, la CPI demande qu’il soit ordonné au requérant de payer des dépens ainsi que les « frais de procédure » et l’« ensemble des frais » dans chaque dossier au motif que les requêtes présenteraient, selon elle, un caractère abusif. Elle demande, à titre subsidiaire, que même si le Tribunal ne prononce pas une telle condamnation, il déclare les requêtes abusives.
    Le Tribunal considère ces demandes étonnantes et tout à fait injustifiées dans les circonstances des présentes affaires. Une jurisprudence constante du Tribunal rappelle clairement qu’une condamnation d’un requérant aux dépens ne peut être prononcée que dans des circonstances exceptionnelles, où elle aurait pour finalité de sanctionner le caractère abusif ou vexatoire d’une procédure introduite ou maintenue (voir, par exemple, les jugements 4487, au considérant 17, 4143, au considérant 7, 3679, au considérant 20, et 3506, au considérant 4). Il est en effet essentiel que l’accès des fonctionnaires internationaux à une juridiction indépendante et impartiale demeure garanti et ne soit pas entravé par la perspective d’une condamnation éventuelle à assumer des dépens, sauf dans des situations exceptionnelles.
    En l’espèce, il est manifeste que des demandes de cette nature sont dénuées de tout fondement.

    Extract:

    As a counterclaim, the ICC has asked the Tribunal “to award costs against the [c]omplainant, including the costs of filing submissions”, on the grounds that he “pointlessly and wilfully initiated and prolonged a dispute, with considerable consequences for the defendant [o]rganisation’s resources in terms of the related costs”, in particular by refusing the offer of an amicable settlement.
    While it follows from what has been said above that the complaint is unfounded, that does not mean that it can be considered as vexatious. Admittedly, in the present case, the organisation does not contend that the complaint is vexatious on account of its actual content but that the complainant did not have a legitimate reason for filing it since he was offered an amicable settlement. However, the Tribunal cannot take account of information concerning any negotiations – which are inherently confidential – conducted by the parties with a view to settling a dispute before it amicably (see Judgments 4457, consideration 2, and 3586, consideration 5). Hence it could not, in any event, issue orders on the basis of such information (see Judgment 4639, consideration 11).
    There are therefore no grounds for granting the ICC’s counterclaim.
